AndThe User who Access or use of the Website, make transaction on the Website and use of Services (as defined herein below) hosted or managed remotely through the Website, are governed by the following terms and conditions (hereinafter referred to as the “Terms of Use” or “Terms and Conditions”), including the applicable policies which are incorporated herein by way of reference. These Terms of Use constitutes a legal and binding contract between You (hereinafter referred to as “You”, the “User”, “Doctor”, “Health Care Provider”, “Patient”, “Pharmacies”, “Labs”, diagnostic centers”, “advertisers”, “End-User”)
It contains conditions you agree to follow when using accessing, browsing or in any way transacting on the Website, or availing any Services on mobile web applications, including when you ask questions and when you view or input content on or into the website or Apps. The Sudha Wellness Privacy Policy Statement or any guideline relating to the use of the website is officially part of these T&C,as relevant under the applicable law(s) in India but not limited to the following for the purpose of accessing, browsing or transacting on the website or availing services from the website and can be accessed here.
This Privacy Policy is published in compliance with, inter alia
the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020.
When you register on Sudha Wellness’s Apps you verify that you have read and agree with the Terms & Conditions as well as the Privacy Policy. This Agreement applies to all services made available by Sudha Wellness on their Website, and their mobile and web Apps.
However, if You navigate away from the Website to a third party website, You may be subject to alternative terms and conditions of use and privacy policy, as may be specified on such website. In such event, the terms and conditions of use and privacy policy applicable to that website will govern your use of that website. Compliance with these Terms of Use would entitle You to a personal, non-exclusive, non-transferable, limited privilege to access and transact on the Website. These Terms of Use constitute an electronic record in terms of the IT Act and rules framed there under, as applicable and amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.
The Website is a platform that facilitates following (i) Online medical consultancy services/ second opinion being offered by third party independent doctors or HCPs or therapists (“Health care providers”); (ii) online purchase of pharmaceutical products sold by various third party pharmacies (“Third Party Pharmacies”) and by the Company; (iii) diagnostic services being offered by various third party diagnostic centers or labs(“Third Party medical diagnostics and Labs”); (iv) Vehicle or ambulance support offered by various third party individual taxi owner or company or organization ( “Third Party Vehicle support”) and (v) online advertisements of various sponsors advertising and marketing their own good and services (“Third Party Advertisers”). The Health care providers (HCP), Third Party Pharmacies, Third Party diagnostics and Labs, Third Party Vehicle support and the Third Party Advertisers are collectively referred to as the “Third Party Service Providers”. Further the Website also serves as an information platform providing health and wellness related information (“Information Services”) to the Users accessing the Website (The services of the Third Party Services Providers, sale of pharmaceutical products by the Company and the Information Services are collectively referred to as the “Services”).

These Terms & Conditions may change. Because your use of Sudha Wellness Apps and Website means you agree to these T&C’s, if we revise and update these T&C’s, your continued use of Sudha Wellness Apps and Website will mean that you accept those changes. You choose whether or not you use Sudha Wellness Apps and Website. If you do not agree to all of these Terms & Conditions, please do not use Sudha Wellness Apps and Website..
APPLICABILITY OF TERMS
For the purposes of availing the Services and/or transacting with the Third Party Service Providers through the Website, You are required to obtain registration, in accordance with the procedure established by Sudha Wellness in this regard. As part of the registration process. Our Apps that do not access any personal and sensitive user data.Cookies and Other Tracking Technologies: We utilize “cookies” and other tracking technologies. A “cookie” is a small text file that may be used, for example, to collect information about activity on the Site or the App. Some cookies and other technologies may serve to recall information previously indicated or submitted by a User. Third party tools and software: We use third party SDKs in Our App. Majority of them are different payment options by which You can make a payment for an order. For example, We obtain certain types of information when Your web browser accesses the Site or advertisements and other content served by or on behalf of PharmEasy.in on other web sites. Click here (OS type and version, App version, Device brand, browser and its version details, User agent) to see examples of the information We receive. We may also receive/store information about Your location and Your mobile device, including a unique identifier for Your device. We may use this information for internal analysis and to provide You with location-based services, such as advertising, search results, and other personalized content. The IT Act and the SPDI Rules regulate the collection, usage, retention and disclosure of personal information, which is defined under the SPDI Rules as any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person. You agree that You are providing all information, including SPDI to Us voluntarily. Collection, use and disclosure of personal information and SPDI requires Your express consent. You are providing Us with Your consent to Our use, collection and disclosure of the personal information and SPDI. You may choose to not provide Us with personal information and SPDI, but in the event that You do so, We will be unable to provide You access to Our App or the Site or deliver products or provide Services through Our Platform.
2.How Secure Is Information About Me? 1. We maintain electronic, physical and procedural safeguards in connection with the collection, storage and disclosure of personal information (including SPDI). Our security procedures may warrant that We may occasionally request proof of identity before We disclose personal information to You. 2. We work to protect the security of Your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information You input in addition to maintaining security of Your information as per the international standards on "Information Technology Security Techniques Information Security Management System-Requirements". 3. You must be sure to log off from the Site or the App when You have finished use thereof. We do not undertake any liability for any unauthorised use of Your account and password. 5. If You suspect any unauthorized use of Your account, You must immediately notify Us by sending an email to the contact details indicated in the contact section. You shall be liable to indemnify Us due to any loss suffered by Us due to such unauthorized use of Your account or password. 6. Under certain circumstances, We shall not be able to take Your prior consent before disclosing Your information in case the information is demanded by government agencies or otherwise mandated under law to obtain SPDI, or during investigation of cyber incidents, prosecution of offenses etc. 7. Further, We shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond Our reasonable control including but not limited to acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of internet service or telephone service of the User, etc.
Retention of Information 1. We also have measures in place such that Your SPDI which is in Our possession or under Our control, is destroyed and/or anonymized as soon as it is reasonable to assume that: (i) the purposes for which Your SPDI has been collected have been fulfilled; and (iii) retention is no longer necessary for any other reason, or under applicable law. 2. We may, however, reserve the right to retain and store Your personal information for Our business purposes, whether such personal information has been deleted or not. After a period of time, Your data may be anonymized and aggregated and then may be held by Us as long as necessary, to enable purchases of products and provision of services or for analytics purposes. 3. If You wish to withdraw Your consent for processing Your personal information and SPDI, cancel Your account, or request that We no longer use Your personal information and SPDI to deliver Our products or provide You services, please contact Us at details indicated in the contact section. Please note however that Your withdrawal of consent or cancellation of account may result in Us not being able to deliver You products or provide You with Our services, or terminate any existing relationship that We may have with You. 4. Please note that uninstalling the App will not result in deletion of Your personal information or SPDI. 9.Changes to Your Information You may review, correct, update, change the information that You have provided by logging into Your account. However, You are not permitted to delete any part of the personal information or any other information generated on the Platform. You may request Us to delete the same. You may update Your information at any point by writing to Us at the details indicated below in the contact section. Should You choose to update Your personal information or SPDI or modify it in a way that is not verifiable by Us, or leads to such information being incorrect, We will be unable to provide You with access to Our Site, App or the Services, as described under the Terms, and such modification may be regarded as the User seeking to discontinue his or her access to Our Site, App or the Services. We reserve the right to verify and authenticate Your identity and Your personal information in order to ensure accurate delivery of products and services. Access to or correction, updating or deletion of Your personal information or SPDI may be denied or limited by Us if it would violate another person’s rights and/or is not otherwise permitted by applicable law. 10.Notices If You have any concern about privacy or grievances on the Site or the App, please contact Us with a thorough description and We will try to resolve the issue for You. Therefore, although We are committed to protecting Your privacy, We do not promise, and You should not expect, that Your information or private communications will always remain private. As a User of the Site or the App, You understand and agree that You assume all responsibility and risk for Your use of the Site or the App, the internet generally, and the information You post or access and for Your conduct on and off the Site or the App. 2. Indemnity: You agree and undertake to indemnify Us in any suit or dispute by any third party arising out of disclosure of information by You to third parties either through Our Site or App or otherwise and Your use and access of websites, applications and resources of third parties. We assume no liability for any actions of third parties with regard to Your personal information or SPDI which You may have disclosed to such third parties. 3. Severability: Each clause of this Privacy Policy shall be and remain separate from and independent of and severable from all and any other clauses herein except where otherwise expressly indicated or indicated by the context of the Privacy Policy. The decision or declaration that one or more clauses are null and void shall have no effect on remaining clauses of this Privacy Policy.
CANCELLATIONS AND REFUNDS ONLINE TELE CONSULTATION Under certain circumstances, you may be able to cancel a transaction on Website and Webapps and be eligible for a full refund of your payment, including when: 1. You submitted a consult to an HCP, and they have not yet opened the message or responded to your query. 2. The HCP declined your consult request for any reason. 3. A technical glitch on the Apps or website caused your consult to not be submitted to the HCP. However, we cannot address disputes or concerns you may have during or after a consult with your HCPs. Any requests for or expectations of refunds in this case must be taken up directly with your HCPs. The customer is required to raise the Refund request with Sudha Wellness customer care within 72 (seventy-two) hours from the time of submission of query or receiving of response. The request for the Refund will be validated by Sudha Wellness customer care team. In case of valid Refund, the same will be done by crediting the bank account of the customer. Refund process shall be completed within 30 (thirty) days from the date of submission of the request for Refund.
PRODUCTS 'Return' means an action of giving back the product ordered at Sudha Wellness portal by the consumer. The following situations may arise which may cause the action of return of product: 1. Product(s) delivered do not match your order; 2. Product(s) delivered are past or near to its expiry date (medicines with an expiry date of less than 03 months shall be considered as near expiry); 3. Product(s) delivered were damaged in transit (do not to accept any product which has a tampered seal): Note: If the product that you have received is damaged, then do not accept the delivery of that product. If after opening the package you discover that the product is damaged, the same may be returned for a refund. Please note that we cannot promise a replacement for all products as it will depend on the availability of the particular product, in such cases we will offer a refund. In the aforesaid unlikely situations, if there is something wrong with the order, we'd be happy to assist and resolve your concern. You may raise a Return request with our customer care within 07 (Seven) days from the delivery of the product. Sudha Wellness reserves the right to cancel the Return request, if the customer reaches out to Sudha Wellness after 3 days of delivery. Upon receiving your Return/Refund request, Sudha Wellness shall verify the authenticity and the nature of the request. If Sudha Wellness finds that the request is genuine, it will initiate the Return and Refund process. Sudha Wellness shall process the refund only once it has received the confirmation from the vendor concerned in respect of the contents of the product relating to that refund. In the event of frivolous and unjustified complaints regarding the quality and content of the products, Sudha Wellness reserves the right to pursue necessary legal actions against you and you will be solely liable for all costs incurred by Sudha Wellness in this regard. The returns are subject to the below conditions:- 4. Any wrong ordering of product doesn’t qualify for Return; 5. Batch number of the product being returned should match as mentioned on the invoice; 6. Return requests arising due to change in prescription do not qualify for Return; 7. Product being returned should only be in their original manufacturer's packaging i.e. with original price tags, labels, bar-code and invoice; and 8. Partially consumed strips or products do not qualify for Return, only fully unopened strips or products can be returned. Category of Non-Returnable Product:Certain categories of products marked as non-returnable on product page, will not qualify for the Return as per Sudha Wellness Return policy. 1. RETURN PROCESS: 1. For Return intimation, please visit www.Sudha Wellness.com/help and chat with us from 10AM to 6PM, Monday to Friday. 2. Sudha Wellness customer care team will verify the claim made by the customer within 72 (seventy-two) business hours from the time of receipt of complaint. 3. Once the claim is verified as genuine and reasonable, Sudha Wellness will initiate the collection of product(s) to be returned. 4. The customer will be required to pack the product(s) in original manufacturer’s packaging. >5. Refund will be completed within 30 (thirty) days from date of reverse pick up (if required). MEDICAL TEST:> In case of medical tests, a Refund request may be raised in the following cases: 1. If the patient has suffered from Haematoma or any prick related injury; 2. If the report has been challenged and no proper justification (i.e. reasonable clarification provided either by Sudha Wellness or the diagnostic centre) has been provided; 3. If the time limit within which a report has to be provided to the patient is breached by 72 (seventy-two) hours and no proper justification (i.e reasonable clarification provided either by Sudha Wellness or the diagnostic centre) has been provided.
REFUND PROCESS: In all the above cases, if the claim is found to be valid, Refund will be made as mentioned below: 4. Order placed through online wallet will be credited to the wallet; and 5. Order placed through cash on delivery will be refunded through fund transfer to customer bank account.

3. CANCELLATION POLICY Customer cancellation: The customer can cancel the order for the product till Sudha Wellness ship it. Orders once shipped cannot be cancelled. The customer can cancel the order for medical test till the collection of sample. udha Wellness cancellation: There may be certain orders that Sudha Wellness partners are unable to accept and service and these may need to be cancelled. Some situations that may result in your order being cancelled include, non-availability of the product or quantities ordered by you or inaccuracies or errors in pricing information specified by our partners. Sudha Wellness also reserves the right to cancel any orders that classify as ‘Bulk Order’ as determined by Sudha Wellness as per certain criteria. An order can be classified as ‘Bulk Order’ if it meets with the below mentioned criteria, which may not be exhaustive, viz: i. Products ordered are not for self-consumption but for commercial resale; >ii. Multiple orders placed for same product at the same address; >iii. Bulk quantity of the same product ordered; >iv. Invalid address given in order details; v. Any malpractice used to place the order. No cancellation charges shall be levied for cancellation of an order in accordance with the terms of this policy.

Refund & Return Policy We offer a 7-day return policy, starting from the date of delivery. To initiate a return, the item must be unused, in its original packaging, and in the same condition as received. Once we receive and inspect your return, we will notify you about the approval or rejection of your refund. If approved, the refund will be credited automatically to your original payment method within 30 business days. For Damage and Defective product If you receive a defective, damaged, or incorrect product, you may request a replacement or refund within 72 hrs of receiving the item. Replacement products will be delivered within 8 days.
